Memorandum of Association
(In the matter of Societies Registration Act of XXI of 1860)
- The name of Society shall be the TIBETAN CHILDREN'S EDUCTIONAL & WELFARE FUND.
- The office of the Tibetan Children's Educational & Welfare Fund shall be at Dharamsala, District Kangra or at such other place (s) as the Governing Body may determine.
- The objects for which the Tibetan Children's Educational & Welfare Fund is being established are :-
- To give protection and help to the Tibetan people, particularly the needy and destitute Tibetan Children, regardless of caste and creed at all levels or physical, social, cultural, religious & spiritual life ;
- To open school/schools at all levels, to organize, promote encourage and control education in the Tibetan community.
- To start, build, construct, manage & organize schools at all levels, crèches, nurseries, homes, hospitals, hostels, sports and recreation rooms, play grounds, cultural & religious institutions clubs, stores, libraries, training classes, vocational classes, training centers with particular reference to carpentry, hoe-making, carpet weaving and tailoring, workshops and laboratories, and equip and furnish them with necessary furniture and equipment;
- To acquire by gift, purchase, lease, exchange or otherwise, land from Government, local body or person, to erect, construct, maintain and establish building/buildings, to sell, acquire, improve, manage, develop, exchange, lease or mortgage, dispose, turn to accounts or otherwise deal with all or any part of the property moveable or immovable;
- To borrow, raise funds by fees, donations, grants from government, cultural shows or otherwise as may be prescribed by the Rules and Regulations;
- To regulate the expenditure and to keep the accounts of the activities of the Tibetan Children's Educational & Welfare Fund.
- To determine and create the posts, pay the remunerations. Allowances, gratuities loans, grants, pensions to staffs, servants and/or their dependents, to create trusts, suspend, remove or abolish the posts as may be necessary;
- To affiliate itself to any Association, Society or body or education or training;
i) To start, conduct, print, publish, exhibit and sell magazines, periodicals, books, pamphlets or posters that may be considered desirable for the promotion of the objects;
- To hold public meetings, entertainment, exhibitions or otherwise as may from time to time be deemed necessary;
- To deposit all money belonging to the Tibetan Children's Educational & Welfare Fund in such Ban or Banks or invest them in such manner as the Governing Body may decide, to drew, make, accept, endorse and discount check or other negotiable instruments and for this purpose to sign, execute and deliver such assurances and deeds as may be necessary;
- To pay from the funds of the Tibetan Children's Education & Welfare Fund all the expenses and costs incidental to the formation of the Tibetan Children's Educational & Welfare Fund and administration of any of the forgoing objects including all rents, taxes, out going and other expenses whatsoever;
- To maintain proper accounts, registers and other records and prepare an annual statement of accounts including the balance sheet in the form prescribed by law;
- To forward annually a report on the activities of Tibetan Children's Educational & Welfare Fund to the Government along with the audited accounts.
- To create, constitute such committees, sub-committees etc. as the Governing Body may deem fit;
- To delegate all or any of its powers to the principle officer or any of its other officer of the Tibetan Children's Educational &Welfare Fund, to any committees, sub-committee etc, to any one or more members of such bodies or any one or more members of the Governing Body;
- To make rules and regulations for the conduct of the affairs of the Tibetan Children's Educational & Welfare Fund and to add, amend, vary or rescind them from time to time;
- To do generally all such thing as are incidental or conducive to the attainment of the above objects
- The Tibetan Children's Educational & Welfare Fund and all the institutions under it will be primarily open to Tibetan children and/or adults of whatever creed, caste, class. The Governing Body, Committee or Sub-committee however may appoint a non-Tibetan teacher, worker or such other person for carrying out the objects of the Tibetan Children's Educational & Welfare Fund referred to under clause/class 3 as above. The Governing body, Committee, sub-committee may admit children and/or adults not belonging to a Tibetan caste or creed. Nothing in this memorandum of the association shall be constructed in such a way as to prevent admission of non-Tibetans.
- No immovable property of the Tibetan Children's Educational & Welfare Fund shall be disposed in any manner whatsoever. Except by the decision of the Governing Body.
- The Central Government may appoint one or more persons to review the work of the Tibetan Children's Educational & Welfare Fund or any institutions working under it, and to hold inquiries into the affairs thereof and to report thereon in such manner as the Central Government may stipulate. On receipt of any such report, the Central Government may take such action and issues such suggestions as it may consider necessary.
- The Governing Body of the Tibetan Children's Education & Welfare Fund shall also be the Governing Body under the Rules to the Tibetan Children's Educational & Welfare Fund Rules.
